Wayfair Ruling Spurs Congressional Action

For over two decades, Congress has introduced legislation to address the issue of online sales tax collection, given that until June 2018, the Supreme Court ruled that tax collection had to prove a physical presence in their state to assess taxes on the purchase. NASE Op-Ed: Ensuring the Healthcare System Works for All

The United States Supreme Court’s recent, historic decision in King v. Burwell, upholding the right of federal premium assistance, guaranteed millions of Americans the right to keep their healthcare. Last month’s ruling, along with the previous 2012 Supreme Court decision affirming the constitutionality of the Affordable Care Act, was a profound victory for the ideal that healthcare should be a right of all Americans – rich or poor, individual or small business owner. Established in 2002, Health Reimbursement Arrangements (HRAs) or Health Reimbursement Accounts are employer-funded, tax-advantaged employer health benefit plans that reimburse employees for out-of-pocket medical expenses and individual health insurance premiums. Health Reimbursement Accounts are funded solely by the employer, and cannot be funded through employee salary deductions.

On Monday, May 6, 2013, the United States Senate passed S. 743, Marketplace Fairness Act of 2013, by a vote of 69-27 (with four Senators not voting). Learn More About the Simplified Home Office Deduction!

On Tuesday, January 5, 2013, the Department of Treasury announced that starting in the 2013 tax year, a new simplified deduction calculation would be available for those with a home office, used regularly and exclusively for business, resulting in a $1,500 standard deduction. Based on $5 per square foot calculation, that would cap the allowable space to 300 square feet.

Overview of the Key Small Business and Tax Provisionsin the July 2025 Reconciliation Package

On July 4, 2025, President Trump signed into law the One Big Beautiful Bill Act [reconciliation package]. The bill includes hundreds of provisions, including extended and expanded tax cuts, and deep cuts to Medicaid, food benefits and other social welfare programs. The bill is also projected to add more than $3 trillion to the national debt over the next decade. Over the course of the last week, Republicans made several last minute changes to the bill, including stripping out controversial provisions (such as a 10 year moratorium on state-level AI regulations and a sell-off of public lands in 11 western states). The package includes significant additional funding to the Department of Homeland Security for immigration enforcement, and to the Department of Defense.
